RE: The tariff classification of two nonwoven glass fiber ceiling blocks from Turkey

Dear Mr. Startare:

In your letter dated March 21, 2007, on behalf of your client, Kazan Trade & Marketing LLC, you requested a tariff classification ruling. Two representative samples were submitted with your ruling request.

The submitted samples, described in your letter as “Parmephon”, are two acoustic ceiling blocks composed of medium density glass wool coated with decorative glass wool tissue. The ceiling blocks will be imported in two sizes: 2’ x 2’ and 2’ x 4’ and will measure either 14mm, 15mm or 17mm in thickness.

You state that the function of the glass fiber ceiling block will facilitate temperature and sound control.

The applicable subheading for the two nonwoven glass fiber ceiling blocks will be 7019.39.1090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for thin sheets (voiles), webs, mats, mattresses, boards and similar nonwoven products: other: insulation products: other. The rate of duty will be 4.9 percent ad valorem.

Articles classifiable under subheading 7019.39.1090, HTSUS, which are products of Turkey are currently entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP, however, is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
